To all those of you who are being harassed by their neighbourhood for tending to animals….

Please remember that for the animals, if not for yourself, you need to be strong and fight this out.

While you can approach local animal welfare organisations or animal activists, but in the end, it is a fight you will have to fight on your own, for yourself and the animals you care for…

  • If talking to people and explaining them the below mentioned laws and constitutional provisions doesn’t help, then, whether you like it or you don’t, you need to approach the Police and file an F.I.R or Police Complaint against all the people who are harassing you, abusing you, threatening to kill/harm you/your property and the dogs/other animals you care for.
  • Be sure to mention full names and addresses of all the people who are harassing you and give complete true account of the matter, without exaggerating facts – take help of the points stated below to put your grievances and facts across and mention why you are seeking help from the Police and reporting this matter.
  • There is no law that prohibits feeding of street animals, and citizens who choose to do so are in fact performing a duty cast upon them by the Constitution of India. Persons, who are trying to interfere with their effort, or display aggression, can be held liable for having committed the offense described in the Indian Penal Code and criminal intimidation.
  • Moreover, as per Indian law, street dogs cannot be beaten or driven away. They can merely be sterilized in the manner envisaged in the Animal Birth Control (Dogs) Rules, 2001(Rules under Indian Prevention of Cruelty to Animals Act (PCA), 1960), vaccinated, and then returned back to their original locations.
  • If your municipality is not doing the same, you can file a Police Complaint or FIR against the local Municipal Corporation for flouting the laws and rules mentioned above, which need to be complied with throughout the country, as PCA Act is a Central Act, i.e. it is applicable across the country and the local Police has been mandated with the responsibility of enforcing this act and reporting/booking violations/offenders.

Constitutional provisions:

  • Article 51A of the Constitutional Law of India, speaks about the duties of every citizen of India. One of these duties includes having compassion for living creatures (Article 51 A (g) of the Indian Constitution). Those who look after animals and other creatures of God are thus protected under the Constitution.

 

  • Article 19 of the Constitution of India, deals with right to freedom and in this freedom are included the right to profession, occupation, trade and business. Therefore, it means that every citizen has the right to occupation and if someone has taken the caring of animals as his occupation, it is legal and he has every right to carry on with his occupation.

Legal provisions:

In a Judgment passed by the Delhi Court, it has been stated that the Animal Welfare Board of India and the Municipal Authorities have in the guidelines issued by them specified the problem often faced by individuals and families who adopt and feed stray animals. The court says that it is necessary to bring into record that these individuals and families who adopt stray animals are doing a great service to humanity as they are acting in the aid and assistance of Municipal Authorities by providing these animals with food and shelter and also by getting them vaccinated and sterilized. Without assistance of such persons no local Municipal Authority can successfully carry out its ABC programme. The Court has proceeded to say that the local police and the municipal authorities are under obligation not only to encourage such adoption but also to ensure protection to such persons who come forward to take care of these animals specifically the community or neighbourhood dogs so that they are not subjected to any kind of cruelty, finally, the Court has said that every individual has the right to live his life in the manner he wants and it is necessary that the society and the community recognize it.

  • If you are a woman/girl who is being abused/harassed/threatened by neighbours/people around for being kind to animals, please also note that you can lodge F.I.Rs against these people Under Section 509 of Indian Penal Code (U/S 509 of IPC) – which is a cognizable offence.
  • Under the Govt. of India, Animal Birth Control Rules 2001 (drafted under the Indian Prevention of Cruelty to Animals Act 1960), no sterilized dogs can be relocated from their area. As per five different High Court orders, sterilized dogs have to remain in their original areas. If the dog is not sterilized, the Society can simply ask an animal welfare organization to sterilize and vaccinate the dog. They cannot relocate them. Relocation is not permissible, as it would cause more problems such as an increase in dog bites as new dogs will move into the area who are unfamiliar with residents and therefore more likely to be hostile. All problems of stray animals have to be handled within the institutional framework available. No association, recognized or unrecognized, shall take recourse to any action regarding stray animals on their own, either themselves or through any person employed by them like security guards. While residents and Associations are free to address institutional agencies for redressal of grievances in this matter, no resident/association will interfere with the freedom of other residents in caring and attending animals.
  • Section 11 of The Prevention of Cruelty to Animals Act, 1960 forbids the displacement of Animals from its natural environment into an environment that is hostile to it, where the animal may be injured/hurt/maimed or killed due to lack of food or fights with other animals. Also, please remember that Prevention of Cruelty to Animals Act 1960 is a Central Act, i.e. it is applicable throughout the country and the powers to enforce this law have been given to the Local Police.
  • Additionally, Section 429 of the Indian Penal Code also provides for imprisonment and fine, in cases involving animal cruelty. Section 429 in The Indian Penal Code, 1860, a Central Government Act, reads as follows:

“Mischief by killing or maiming cattle, etc., of any value or any animal of the value of fifty rupees.– Whoever commits mischief by killing, poisoning, maiming or rendering useless, any elephant, camel, horse, mule, buffalo, bull, cow or ox, whatever may be the value thereof, of any other animal of the value of fifty rupees or upwards, shall be punished with imprisonment or either description for a term which may extend to five years, or with fine, or with both.”

      I am writing this letter to formally request you to help me in dealing with an issue with my neighbour.
      The family I am complaining about – Lawangare, 3rd floor, Flats A7 and A8, New Giri Vihar CHS, Gokul Gully, Opposite NES International School, Nimbkar Society, and Pratiksha building (Home to MLA Vijay Joshi), Mulund West, Mumbai 400082, Maharashtra, India
      I have also enjoyed living in this colony for several years. However, for the past two years or so, I have been facing a lot of problems. My upstairs neighbours the Lawangares are making thudding and screeching noises every night and I have even sent the police audio recordings as evidences every night but the nuisance to me and my senior citizen parents just does not stop from upstairs even late at night and it causes me headaches, heartaches and even dizziness and more. Even during the day they wreak havoc. I have even sent the building secretary and chairman audio evidences regularly but nothing has been done about this since 2 years.
      This type of daily late night disturbance is not allowed in the apartment and particularly when sensitive people such as women and senior citizens are residing in the house beneath that of the Lawangares or anyone else. We have even requested this family thrice in person not to make noise so late every night to which he gave rude back answers and replies with twisted words instead of simply complying to our polite requests that would have made living here harmonious. Nowadays, we feel helpless and have had to resort to drastic measures against this family because they are continuing to be a nuisance. I hope that we can find a resolution to this problem as soon as possible. I appreciate your attention and thank you for understanding and support. Also, please note that they even jog on their treadmill any time they want, wreaking havoc in our house, rendering us sleepless and tired.

      We are legally domiciled in the state of Maharashtra and our family traces back to the early 1940s and have been here since that time but still, we have to face harassment and discrimination by the upstairs neighbours, who have recently moved into our building unlike us.

  2. recently i had a quarrel with a flat owner in my building.. in our society premises .he actually took the opportunity of harassing my younger sister who was out far a walk with our dog . my dog peed ..on the society road … not in anybody’s parking or car tires. he spoke very rudely and also ordered her to get water and clean it. then i personally went for the issue, i told him about the laws animal rights, and told him that he is a threat to me my family and my dog …and if this happens again i would complain to police. he is the committee member in society for our building . he said he will be sending me a notice. my question for you here is that … if he sends a notice should i go and complain to the police? .. i have got a notice from society before also .. the thing is that they will have a record. which can be used against us , and instead complain about us only that we are not co operating. so if he sends a notice again should i lodge a police complaint??

My neighbor has 4 cows in parking place very near to my house they never clean der shelter and his son beat up those cows really bad. this creating so much nuisance, we cant even open our doors and windows, these cows had ticks it transferred to my dog, when we asked him to move this cows cuz of filthiness he is threatening us and said he will kill my dog because keeping dog is illegal even though we have licensed our dog.
    is it legal to keep cows in residential area?? we are really annoyed by this neighbor plz do rpl what should i do??

    I have been taking care of 4 street dogs feeding them and they stay in my compound I only leave them for toilet etc for 5-10min daily and stand till they come inside but my neighbors give false police complaint against me saying my dog bite them etc and ask money lhhave done all vaccination and legal licence for them. What to do as every time they put false complaint n demand money they are 4-7 members only who troubles me. Please tell how to tackle this people forever my location is pune maharastra

    • Get a complaint filed against them in the Police station or atleast threaten them that you would do so. Also connect with local animal welfare organisations in your area, even they can issue warning letters

  5. Sir, I have a pet dog how is 11 yr old and he is with my parents how are more than 60 years old. Both my parents and the dog can not walk properly, so they take him out for pee & poo, untied. Although they take care he does not do anything inside the apartment compound, one of my neighbor who is scared of even with the site of dogs keep on complaining about every thing. Why don’t you keep him tied, his hair spreads hear and their, why he barks from inside the locked door, etc. He is not our dog but more than a kid to us. He is so scared that he hardly wants to go out. He also needs exercise, fresh air. We take good care of him, so as not to hear any complain but still complains are there.

    i had 5 stray dogs outside my home and one at home..recently i setrellized all of bitches.. but one of them is replaced by the hospital and i call them,they didn’t told anything about that dog..
    today one of my neighbor started fighting with my mom,saying “you are dirty,surrounded by dirty dogs. you don’t know the name of cleaning also ” etc. etc. i m a married women,living in ranchi and my mom is in delhi.. i m felling helpless,cant do anything from here.. i want someones help .
    my neighbors are so cruel ..no one raise their voice when all that was happening with my mom..
    if i will file FIR ,the one who fought with my mom will definitely do something wrong with my family..

    There is a pet dog in house next to mine activists are fighting for rights of dogs and cats. But if that dog is running behind everyone and biting children playing and any passer-by then what are the right of those poor people who have been bitten by the dog.

    Can you explain those right of poor people since you are most caring about the animals.

    • If its a pet dog then the owners are to be blamed for letting him out without a leash or unaccompanied by his/her owners. They need to ensure their pet has updated vaccinations and is trained. Please speak to the owners on this, it is not the dog’s fault in this case.

      • So its not a fault of dog and as per me certainly its not fault of children playing. So what action should be taken against the owner. What about the painfull situation faced by little children even if the dog is vaccinated. Does vaccinating a dog gives license to bite anyone. Can you feel that pain ? What action should be taken and what is the process to take. Can you explain for poor children’s sake who have suffered this who are feeling scared of going out of the home. I am more concerned about children.

      • You still have not answered us whether the dog in question is a pet and whether you have spoken to the owner? Yes, we have been bitten by a dog so understand the pain. But it was my fault all 3 times that happened. Getting bitten by a vaccinated dog is better because atleast then one doesn’t have to take the 5 pist bite vaccine course.

      • Yes, the dog in question is a pet dog surely the parents of victims have talked to them and this incident repeated 4 to 5 times and children have to this threat that our society don’t care human but dogs. Court could not rule to provide shelter to poor people but for dogs. Since you said you have been bitten by dog it seems that was a good experience for you. I cannot stop laughing when you said that dog bite you 3 times and its your fault show you are not learning from your faults though you are trying to teach the society. it may be good for you to be bitten by vaccinated dog its your wish.These all are your personal understandings and feelings and I respect that. What I want to know is since the owner know this issue and still children are scared of going out of house is also a kind of crime an d I am sure you will be having knowledge of this as per law. And law should work towards removing fear of any individual and gives freedom to walk in this country though children cannot in their street and you don’t care about that.

        Leave everything apart tell me how and what action can be taken against the owner for their carelessness due to which our so called right to move or roam is being breached.

  10. @hemant is not looking for a solution, he’s just looking for a fight. I was a kid once. There were dogs which were ferocious in my colony ,but I had the brains not to go close to them. I would have preferred it if all dogs were friendly but then I would also have preferred it if dumb idiots like Hemant weren’t born but I just have had to live with it.

  12. My flatmate’s two dogs and one of them is very aggressive with a history of biting people. The dog’s Saint Bernard. This dog attacked me brutually few days back and bit me on chest causing 3 cm deep wound. He doesn’t tie him and neither he puts any be aware sign. I filed the FIR and reported this matter to PETA. Nobody’s visited our place till now to check on dog. The dog has skin infection and he roam around drooling everywhere freely. Now my flat mates threatening me to leave the house and started loosing his dogs in front my room when I am in it. Can anyone help me how can i deal with it. Any help or information shared will be highly appreciated.

  13. hello there, but what to tell to those people who are illiterate or just dont give a damn of anything. i am an animal lover. i usually feed the street dogs and cats and help the needy animals as i can. but my neighbors are troubling these street dogs. as i feed these dogs it is but obvious that they sit at the gate all the time. and today i saw my neighbor hit a dog in the eye and wounded him. i told him not to do so but in front of me he hit another dog with a stone and wounded another cat. i dont know what to do of such people. help me

  14. today i saw my neighbor very brutally stoned a street dog in my residential area. i told him not to do so but he was not attentive to my talk and stoned the street dog and was laughing and making fun when the dog cried in pain. i tried to stop him but i was incapable to do so. he was not under the influence of alcohol and is mentally stable and hence i don’t see any reason to do such brutal act.

  15. We have a residential dog that sits in my building my family feeds her, we have got her vaccinated and sterilized by an NGO in Malad. Neighbours keep trowing water in her food and also throw water on her.Their child hit her, but she is very friendly does not bite but will cry in pain. Recently my next door neighbour kicked her hard and she screamed in pain and hide, after 30mins we found her. she was shivering in pain and crying. We complained to the Versova police station, however at first they did not take out complain, then after 5 days we again went and lodged FIR. Bldg Secretary and treasurer both are supporting this neighbour and say they have support from the area MLA. and they are pressurizing thru the cop who took the FIR, he is calling and msging to return the FIR copy. Please help. I will require a number whom I can spk for Support. I cant afford to fight a case.

    • The recent atlrticle was mis-interpreted and reported incorrectly (they later clarified).

      This was a specific case filed in the HC by one family upon another who used to feed dogs in a common area. The judgement is specifc to the family in question (the respondent) and it does not change anything with respect to the AWBI guidelines.

      The apex court in India is the Supreme Court and its ruling stands valid which is in line with the Indian constitution. Please continue to feed without any doubt, choose a relatively secluded area with less footfall. Thanks.

  18. Hello,
    We have a stray cat whom we have been taking care of for past 3-4 months. We feed her and let her sleep in our apartment for few hours and let her go when she wants. Our apartment have been creating lot of issues and picking fight with us to not feed her. We have on earlier occasions tried to keep her at home for longer time but she won’t stay as she is a outdoor cat. She gets stressed when we try to make her stay for longer.
    She has given birth to 3 kittens very recently and they are inside our home. Now the association members and some residents have warned us to not let the pet in common areas. She is not a domesticated cat so she has been going in the play area in sand to pee or poop. We have tried to take her outside the compound but she has mind of her own.
    Few months back they put the cat and kittens in separated bags without our knowledge and abandoned in different areas. We had plans then to get the cat sterilized after the kittens were old enough but before that they were separated. And in next few days she got pregnant again.
    After our today’s argument with many other residents we have now realized that it is now not safe to let her out as we fear they may hurt her or take her somewhere to abandon. We work full time with hardly any time to be always available at home. We are taking help from family members temporarily for a month to baby sit them and make sure no one causes any issue. We have suggested them below things for which no one has replied and agreed to. We are meeting them again in person on Saturday to explain the situation.
    Steps we suggested our Association,
    1) For the next few weeks, the cat will be in our home as she has kittens. The cat will not be venturing out into the common area without supervision. If the cat poops outside under our supervision, we will dispose it appropriately.
    2) When the kittens are more then 4 weeks old, we will put them up for adoption. There are several Facebook groups in which we can do that.
    3) We have setup a litter box in our house and we are trying our best to make the cat use it.
    4) The cat does not have any flees for many months now. We have given her medications for that.
    5) We will get this cat spayed so that she can’t have any more kittens. We will do this after she starts weaning the kittens or after kittens are adopted.
    We would like to know how do we handle this situation and explain them about the laws for animals so they do not attempt to harm the cat or relocate it. We are scared for the cat as we cannot lock her up and force to always stay indoors. Please advise.

  19. We live in an apartmenf in Hyderabas. My neighbours have 2 cats and they are chained 24/7 in the common corridors. These animals urinate and shit the area leaving the corridors stinking. They are hard core muslims and always fight with everyone one and also among themselves. So no one dares tell them. How to liberate these poor creatures. they also chain some pigeons. I believe every living creature is born free and it should never be chained curtailing its freedom. Not once they are taken for a walk too.

  20. My neighbor keeps shouting at me because my dog urinates on the road in front of his house. Please note it only the road that my dog urinates and not near or on his gate. I can understand if my dog defecates, I am responsible to clean it up. And I do it diligently. However am in not in control for my dog urinating on the road as there are other street dogs as well who sit there and it is natural instinct for a dog to mark its territory. Please let me know if there is any restriction for pet dogs urinating on the road.

One among them is Pets(especially Puppies) being dumped in a very small cage at Pet Shops without no ventilation, food & water & kept at the entrace of the shop under hot sun, during the peak summer too. This happens throout the year in a pet shopt nearby by residence. What can I do for this. There was no action taken against my complaint to SPCA. The inspector could not even give me a registration number for the complaint I had given.When asked he rudely replied ‘you have complained & after this its our responsibility to follow.
    Sencondly, everyday i’m receiving too many forwarded whatapp videos pertaining to animal harrasments.I’m not only upset, but heart broken. Pls help me with a TRUE animal care welfare associations, mainly to complaint on animal cruelty.

    I am living in a rented house in sector 29 Noida.

    There are few stray cats in the locality and they come to my house everyday and I feed them food, the neighbours however dont like it and ask me not to feed them as they breed faster.

    I feel bad because I am working and not in a situation to adopt cats.

    Please suggest what can be done in this case as I cannot ignore cats when they come to my door for food.

Recently I fixed collars to 2 female strerilised dogs whom I feed and provide water and shelter especially in wet weather .The dogs do spend about 8 hrs a day inside my compound but go and come as they wish.Some residents on our street say that since I provide them food and shelter and have even collared them,I am responsible if they bite any one .Ofcourse these 2 Dogs have been vaccinated and sterilised and would not hurt a fly?But just in case,does collar fitting the dogs make me responsible for any thing they do?Even the children in our area love the 2dogs and come and play with them but the adults hate them.

    • No. It doesn’t make you responsible for the dog’s actions. Infact you have fulfilled your responsibility as their caretaker by getting them sterilized and vaccinated…if not for u they would have kept giving birth after birth…where are you writing from? Show the AWBI circular and above laws to those who harass u or the dogs…

    I take care 4 street puppies like feed them, provide bedding in winter time. Due to this our neighbor don’t support us and always arguments with us. Sometime puppies spread garbage then my neighbor shout and said to me clean it. Kindly let me know if any law against it and how to handle with them.

  26. Animal welfare at the cost if human welfare!
    It is good to take careof animals. But If these people are truely concerned about animal welfare they should first stop eating non-veg. Otherwise it is a sheer hypocrcy of shedding crocodile tears. God save this country.

    I am Poonam from New Delhi.
    Our family has provided shelter to few cats and their kiities.
    Now one of our neighborhood complained me at the midnight when I went out to see my cat and that man yelled at me and threatened me to stop feeding the cats and ask me to kick all the cats out of our house stating that the cats creates mess at their place.
    That man with his wife literally harssed me at night and threatened me that they and the other people will mark the police complaint against us if we did not abandoned our cats and they suggested us to keep the cats inside the house untill they die..
    Please suggest the kind of action I can take against them.
    This is the second time they harssed us like this in the road.

    My name is Prashant from pune
    I stay in a government premises.
    From many days our neighbors are beating street dogs near my house..Though we are animal lover we keep feeding them but now it’s a summer sun is very hot and due to which dogs are finding shelter and digging in ground.. My neighbor has made a great garden but sometimes one dogs goes to sleep in the garden as temparture is too high and they do not like it that’s why they keep beating dogs there entire family including 2 small children with 1 big stick throwing stones and stick at dogs.. Though it’s a govt area the area does not specify to anyone it’s govt. Property
    I tried took some video footage as an evidence but it was a bit late..
    Also my neighbor and us has a personal fight in past and we filled an FIR from both side.
    Now as we are animal lover they tried to beat animal and take a kind of revenge..but that’s not right.
    It’s kind of emotional harassment for us. As my family cannot see animals beaten.

    Can you please advise what steps should I take to stop our nebiors from harassing animal.

  29. Sir, I am a resident of Pune..and I feed stray dogs in my society. But I am getting a notice of fine for feeding stray dogs.. Moreover a neighbour who stays opposite to my bunglow had called a van from PMC for relocating stray dogs, When I spoke to the PMC people they went away & told the neighbour that relocating & catching sterilised dogs is against law.

    But I fear they will get the illegal reloaction done through the society watchman who does this type work for some money.

    Will you pls suggest how to deal with this.

  30. Hello there, I am really glad to find this article.
    I am from Bangalore and stay in a residential area. We have three pet cats and also treat and feed resident strays around whenever required. Our neighbouring family has had problem with us throughout and of late, they are harassing our family much more than usual, claiming that our cats are littering in there premises. The son of the family even threatened to kill all the cats. We have even gone and cleaned the cat litter though it was not even our cats’ , trying to keep peace. The have filed a complaint to the Municipality as well that our cats are dirtying their house and creating havoc in their life.
    Please suggest what we can do from our end.

  32. I daily feed 8stray dogs with my own money… I don’t run any NGO. But people in my colony they think I get money from NGO bcoz of that I am feeding stray dogs.
    There are 7-8 ladies are planning to kick me and my family from the colony just because I am feeding them in our colony.
    Tell me one thing If I feed dogs outside the colony what is the guarantee that dogs pee or do potty outside the colony?
    They are dogs they don’t have washroom like us.
    Understand we have brain so USE IT instead of Harrassing or abusing the ppl who are feeding Dogs.
